Designated/Dual Agency Limitations
To practice designated/dual agency legally and ethically, each agent in an office will need a firewall of protection around him/her. Individual agents will need their own secure office or/and conference facilities, phones, files, fax, email etc. It’s simply unrealistic to believe buyer agents and seller agents sharing the same office, maybe even the same desk are able to keep all Client information secret from each other. Buyers and sellers alike will be at a great disadvantage as only ONE agent will be representing their interest and the rest of the company may be representing the opposing side. The consumer (buyer or seller) simply does not get the full-office support and service they should receive and which they are paying for. A “designated” agent is exactly that – ONE agent is designated or appointed to be on your side! Designated/Dual Agency is a limited relationship, with limited responsibilities! BUYER BEWARE!!Today, everyone with a license wants to be your buyer’s agent. There are many problems that can arise from making a poor choice when looking for a buyer’s agent. The most damaging is the conflicts of interest that can arise when your buyer’s agent works for a company that has loyalty obligations to sellers and/or has seller loyalty obligations of their own. These conflicts can strip you of the most important reasons for having a buyer’s agent …advice, advocacy and full 100% loyalty to you, the buyer.
