Pacesetter Guarantee

Pacesetter guarantees that if you, the Buyer, bring to our attention any manufacturing or installation defect in the products you purchase from Pacesetter within THIRTY (30) DAYS following the date of installation, and we are unable to correct the defect within one hundred twenty (120) days, we will refund to you any money you paid for the defective product(s) or deduct the price of the defective product(s) from any unpaid balance you may owe.

Conditions and Exclusions

1. This MONEY-BACK GUARANTEE supplements and is in addition to the express written LIMITED WARRANTY provided to you by Pacesetter. All exclusions in that LIMITED WARRANTY are incorporated in and apply to this- MONEY-BACK GUARANTEE as if set forth in full herein.

2. This MONEY-BACK GUARANTEE shall be null and void if (a) Pacesetter workers did not install the products; (b) Buyer used the products for purposes other than those for which they are intended or misused the products; (c) at the request of the Buyer the products were installed in a manner other than as recommended by Pacesetter; or (d) the products or installation were altered, repaired and/or replaced by someone other than Pacesetter.

3. Any claimed manufacturing or installation defect is subject to inspection by Pacesetter personnel and final determination as to the existence of a defect will be made by Pacesetter. If we determine a defect exists, we must be given the opportunity to refinish, repair or replace the defective product(s).

4. Any refinishing, repair and/or replacement of a product will be performed by Pacesetter within one hundred and twenty (120) days after Pacesetter’s determination that a condition of defective manufacture or installation exists.. If we fail to do so, you will receive your refund for the defective product(s) within the following 30 days.

5. All service provided by Pacesetter pursuant to this MONEY-BACK GUARANTEE will be performed during Pacesetter’s normal working hours.

6. In the event that any component part or product covered by this MONEY-BACK GUARANTEE is not available, Pacesetter has the right to substitute parts or products of equal grade or quality.

7. This MONEY-BACK GUARANTEE applies only to (a) those products and services described in the Buyer’s contract, and (b) actual, observable defects in the products and/or workmanship. It does not apply to any oral or written claims, conditions or representation regarding the products and/or services not expressly contained in this MONEY-BACK GUARANTEE or the LIMITED WARRANTY.

8. You acceptance of payment under this MONEY-BACK GUARANTEE cancels the LIMITED WARRANTY covering the defective product(s). You will be required to sign a full release of all claims under the LIMITED WARRANTY related to the defective product(s) as a condition of receiving your payment under this MONEY-BACK GUARANTEE.

THIS GUARANTEE COVERS A CONSUMER PRODUCT AS DEFINED BY THE MAGNUSON-MOSS WARRANTY ACT. NO WARRANTIES, EXPRESSED OR IMPLIED (INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) SHALL EXTEND BEYOND THE APPLICABLE TIME PERIOD STATED IN BOLD FACE TYPE ABOVE.

THIS MONEY-BACK GUARANTEE GIVES YOU SPECIAL LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
